Terms and Conditions

 

The GoStay.com.au website ("Website") is operated by Australian Online Travel Pty Ltd (ABN 17 105 135 331) of Level 4, 18-22 Pitt Street, Sydney NSW 2000 ("Australian Online Travel") under a licence from Sensis Pty Ltd (ABN 30 007 423 912) ("Sensis").


When you use the Website, you do so under an agreement with Australian Online Travel on the terms and conditions set out below (“Terms”). Australian Online Travel reserves the right to change these Terms at any time, by posting the changes on this Website, and you agree to be bound by such changes. These Terms govern the use of the Website and any bookings for Accommodation. Separate terms and conditions apply to a booking or purchase of Activities. Activities bookings and purchases are made through Red Balloon Pty Ltd (ABN 097 376 442) trading as GoDo (“GoDo”). When you use the Activities tab you will be redirected to a website operated by GoDo. To view a copy of these terms and conditions click here. If you do not agree with any part of these terms and conditions, you must not use the Website. Sensis excludes all liability to you in relation to your use of the Website.

Responsibility

Australian Online Travel acts as an agent on behalf of Travel Suppliers contained herein and the Travel Suppliers are responsible for the provision of the services specified. Australian Online Travel has made every endeavour to ensure the details contained herein are in accordance with the information supplied by the operators but accepts no responsibility for any inaccuracy or misdescription. Descriptions, photographs, and facility lists are included as a guide only and may not necessarily reflect the Travel service. As agent, Australian Online Travel accepts no responsibility for any damage, loss, injury, delay or inconvenience arising out of the provision of or failure to provide services by the Travel Suppliers.

 

Prices

The prices for Accommodation contained herein have been specifically negotiated by Australian Online Travel. Prices do not include transfers or meals unless specified. Prices contained herein are subject to change or withdrawal without notice at any time.

Amendments

Amendments to a booking for Accommodation will incur a booking amendment fee of A$20 (includes gst) as well as the difference in price if the price is greater than that originally booked. A change request within seven days of the original arrival date will usually be treated as a cancellation.

Cancellations

Australian Online Travel charges a cancellation fee of A$40 (includes gst) for all bookings for Accommodation cancelled. Refunds will be made to your credit card account. If the cancellation is made within one month of the arrival date, the Travel supplier may charge an additional fee depending upon their own cancellation policy. For bookings for Accommodation cancelled within seven days of the arrival date, or during peak periods, the Travel supplier reserves the right to charge a 100% cancellation fee. Australian Online Travel strongly recommends that you take out appropriate travel insurance.

Special event prices

There are many special events, as well as holiday periods that may attract a surcharge imposed by Hotels. These surcharges may not be known at the time of publication and where bookings are made more than two months in advance. Any surcharge will be advised on confirmation of the booking from the respective hotel.

Age and responsibility

You represent that you are of sufficient legal age to use the Website and to create binding legal obligations for any liability you may incur as a result of the use of the Website. You understand that you are financially responsible for all uses of this site by You.

Jurisdiction

This Agreement is governed by the laws of the State of Victoria, Australia and you agree to submit to the jurisdiction of the courts exercising jurisdiction in that State.

Copyright

Australian Online Travel and its licensors (including Sensis) retain all rights (including, but not limited to copyright, patent and other intellectual property rights) in and to the content and design of the Website. Australian Online Travel uses the "Go Stay" branding and the <GoStay.com.au> domain name under a licence from Sensis. Sensis retains all rights (including intellectual property rights) in the "Go Stay" branding and the GoStay.com.au domain name.

Except as set out below, or as permitted under applicable laws, you must not reproduce, adapt, store in a retrieval system, transmit, print, display, perform, publish or create derivative works from any part of the content or design of the Website. You may view the content of the Website on your Internet browser and also print off copies of the content of this website: (a) for personal or non-commercial purposes; and (b) provided that you do not remove or modify any copyright notices.

You are not authorised to represent that Australian Online Travel, Sensis or the Website is affiliated with or endorses, sponsors or otherwise approves of you or any website that you operate.

Privacy

Australian Online Travel may collect personal information about you in the course of your use of the Website (for example, when you make a booking using the Website). That information is subject to Australian Online Travel’s Privacy Policy.

In accordance with that Privacy Policy, Australian Online Travel may share the personal information it collects from you with Sensis, and Sensis may use that information in the same way as Australian Online Travel.

Third party sites

The Website may include links to other websites that are operated by third parties ("Third Party Websites").  Neither Australian Online Travel nor Sensis accept any responsibility for your use of the Third Party Websites and have not checked: (1) the accuracy or completeness of any information; or (2) the suitability or quality of the goods and services, made available on the Third Party Websites.  Your use of the Third Party Websites may be subject to separate terms and conditions displayed on the Third Party Websites.  You acknowledge that Australian Online Travel and/or Sensis may receive commissions in respect of goods or services that you purchase on a Third Party Website when you access that Third Party Website using a link on the Website. For instance, Activities bookings and purchases are made through Red Balloon Pty Ltd (ABN 097 376 442) trading as GoDo (“GoDo”). Acceptance

By selecting the "PAY NOW" button on the payment page or downloading any material or by accessing any data, information or material using the Website, you agree to be bound by these terms and conditions.
